Para aquellos que tienen archivos de musica alojados en los sistemas P2P pensaron que no les afectaría por estar ya utilizando los servicios de descarga directa pueden empezar a temblar. Las discográficas han colocado en su punto de mira a Rapidshare, el servicio de alojamiento de archivos más usado del mundo. La policia alemana asalta las casas de los usuarios que suben archivos protegidos y la discográficas quieren cerrar la página definitivamente. Esta vez no quieren hacer prisioneros.

Rapidshare se encuentra en el ojo del huracán ahora mismo ¿resistírá en pie?

No hay respiro. Cada mañana Internet se despierta sobresaltada con un nuevo ataque del lobby audiovisual. En Suecia han caído los dueños de The Pirate Bay en un juicio plagado de irregularidades, en Francia se reúnen hoy para aprobar definitivamente la restrictiva ley de los 3 avisos y en España no tardarán mucho el seguir sus pasos visto el poder que ha adquirido el lobby anticultural en la persona de la ministra de Cultura. Ahora le toca el turno al referente indiscutible en el mundo de los servidores de descarga de archivos: Rapidshare]. Esta empresa de origen alemán ya tuvo sus batallas legales en 2008 por alojar contenidos protegidos con derechos de autor. La justicia alemana le exigió a la empresa de alojamiento que mostrara claros esfuerzos por eliminar archivos ilegales pero el asunto no pasó a mayores. Rapidshare sigue en la cúspide de las páginas de descarga directa aunque, efectivamente, ahora borran con mayor rapidez los archivos que son denunciados por los usuarios afectados. El proceso lleva su tiempo porque muchas veces estos archivos se suben fragmentados y con una contraseña de acceso que hace imposible saber lo que hay dentro. No sabemos muy bien cuáles son las técnicas que utilizan los dueños del servicio para considerar un archivo como ilegal, pues con la cantidad de miles de ellos que suben los usuarios a todas horas se nos hace muy complicado creer que se los bajan todos y los comprueban en primera persona.

Rapidshare afirmaba haber contratado a seis trabajadores con el único objetivo de revisar el material alojado en sus servidores por los usuarios, y a borrar aquellos archivos con copyright y responder a las quejas y peticiones, tanto de quienes los subieron como de quienes solicitaron su retirada. Sea como fuere, esto no les parece suficiente a las discográficas. Viendo que los internautas suben dos archivos por cada uno que borran, están virando en su estrategia y se van a dedicar a criminalizar a los propios usuarios con todas las de la ley.

Las discográficas quieren aprovechar una ley alemana que les permite exigir a sitios P2P y de descarga directa datos personales sobre los usuarios que violan la propiedad intelectual al subir a los servidores archivos protegidos. Y así lo han hecho con un usuario que relató como su casa era asaltada por la policía simplemente por el hecho de haber subido a su cuenta el último disco de Metallica. El sello discográfico dueño de los derechos de autor del disco citado, pidió la dirección IP del usuario a Rapidshare, y después exigió a DeutscheTelekom que identificara al usuario en cuestión antes de enviar a los agentes de policía. Y este ha sido el primer caso de muchos que se esperan sean acosados por las discográficas que han visto un filón enorme con el asunto de poder llegar hasta la identificación del usuario que aloja archivos con derechos de autor. La estrategia promete. No hace falta denunciar a todos (eso sería inviable), pero en cuanto se extienda por todo Internet que unos cuantos han caído, el resto correrá a esconderse dejando a Rapidshare desierto de archivos y clientes. Y para rematar la faena, la industria audiovisual pretende el cierre total de Rapidshare.

Y yo me pregunto ¿Qué habría pasado si el usuario hubiera creado su cuenta y subido la canción desde un ciber? ¿Y si la sube desde el Internet de un amigo? ¿Y si lo hace hackeando una conexión Wifi (sencillísimo)? ¿Y si sube el archivo desde un Proxy anónimo? ¿Vendrá la policía asaltando casas, cibers y servidores proxy de todo el mundo por un disco de música?

Los países emergentes que no tienen leyes restrictivas contra el uso de los P2P pueden estar empezando a frotarse las manos. Si consiguen derribar a Rapidshare a base de atemorizar a sus usuarios y clientes, el siguiente paso será migrar hacia servidores instalados en esas regiones consideradas paraísos legales. ¿Veremos pronto un Rapidshare argentino?¿O un Rapidshare rumano o ruso?. De hecho, ya existen servicios equivalentes que ofrecen alojamiento en servidores de esos países, pero por ahora no han tenido mucha aceptación. Ya veremos que sucede cuando el servidor alemán doble la rodilla.
